What Are Depositions Used During Probate Litigation?
In any lawsuit, all sides have a right to a formal investigation of the facts and circumstances surrounding the case. This investigation is called “discovery.” In discovery, all parties gain valuable information about the disputed matter from witnesses and other parties that can be used to strategize their case. Depositions, which are oral statements taken under oath by witnesses before the start of a trial, become important matters in this process.
Depositions bring to light what you as a witness know about the case and they preserve your testimony so that it can be used in court. Depositions are commonly conducted in law offices wherein you will be asked a series of questions by an attorney about the facts and events surrounding the issues at the heart of the lawsuit; your words will be recorded in entirety by a court reporter. You are allowed to have your own attorney present during a deposition who can make objections to certain questions if necessary. However, you are generally required to respond to all questions that are appropriate.
